Charging Trump Not An Option

Special Counsel Robert Mueller, has emerged from the shadows in his first public address on his two-year investigation surrounding President Donald Trump and his presidency campaign.  Mueller headed his dramatic announcement stating that his office did not charge Trump with a crime because ‘it was never an option’ under Department of Justice (DOJ) regulations.

Irrespective of the timing, the accusations have been investigated by the FBI, Department of Justice and their counterpart the Special Counsel. Robert Swan Mueller spearheaded the investigation counsel since it began in May 17, 2017 which has been actively examining the circumstances of the election. Inquiries into the connection of the US and the hostilic Russian Government are being carried out, however Mueller has since conceded; choosing not to continue pursuing the Trump administration’s apparent misconduct.

Historically

Controversy and the Trump Administration have gone hand in hand since the President’s announcement of his candidacy in June 2015. To put simply, the FBI believed the release of information by the Russian Government was being coordinated by individuals associated with Trump’s campaign. By October 21st 2016, the FBI obtained authority from the Foreign Intelligence Surveillance Court to monitor Trump’s campaign advisor Carter Page.

Page was accused of sharing information and research with a Russian national who was later accused by the FBI of being a Kremlin spy. Concurrently, the investigation revealed that Representative Dana Rohrabacher met with WikiLeaks founder Julian Assange. This meeting took place months before the site released compromised emails involving John Podesta, Clinton’s campaign chairman which was passed on by Russian hackers.

The release of the alleged emails couldn’t have been more perfectly timed for the Trump campaign. Obviously, adding fuel to the insofar fire, the scandalous liberation of the intelligence on October 7 2016 brought the Russian Probe investigation forward to the general public. Then-FBI Director James Comey settled conspiracies by confirming the bureau’s investigation of links between Trump associates and the Russian Government in March 2017. The Times later admitted the pre-election story “gave an air of finality to an investigation that was just beginning”.

Trump indirectly used the current circumstances to his advantage. The glaring issue associated with the release of the information is how it ultimately swayed the result of the election. With the wrongdoing of the Trump administration still being uncovered, arrests, fines and judgement has already been passed onto those accused and convicted. Most of the judgement passed was thanks to the efforts of Robert Mueller and his leadership of the Special Counsel.  

Currently

Mueller was assigned by Deputy Attorney General Rod Rosenstein, the task by to investigate “any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump” as well as “any matters that arose or may arise directly from the investigation”. This in its entirety was no simple feat, but declared the matter a “concerted attack on our political system” that “deserves the attention of every American”. Today, Mueller broke his silence, pointedly avoiding exonerating Trump of obstructing the probe.

Most recently, Mueller today finally broke his ‘silence’ regarding the investigation of the Russian Probe. Despite tiring efforts investigating the probe in the background, the prolonged ‘secrecy’ of the investigation is being scrutinized as Mueller announced that charging the President was “not an option”. Mueller reluctantly admitted that “Under longstanding department policy, a president cannot be charged with a federal crime while he is in office. That is unconstitutional.” Further claiming his hands are tied, “Charging the president with a crime was therefore not an option we could consider.” explaining how the Special Counsel’s office was constrained “by regulation (of the Department of Justice), it was bound by that department policy.”

Nonetheless, Trump labelled the Probe as a “Witch hunt” and considered the findings in Mueller’s report  a waste of $7.7 million despite the Justice Department having a budget of $28.1 billion in 2018. However, Mueller stands by his report stating “The report is my testimony”, adding he would not diverge from the report if summoned to appear before a court.  Mueller implying that this report could potentially be used in impeachment proceedings.

Looking Forward

In light of the realisation that charging Donald Trump is not an option, pressure on Democrats is now mounting to open an impeachment hearing. The Special Counsel led by Robert Mueller being deemed counterproductive by reporters, was defended by the forerunner stating “If we had had confidence that the president clearly did not commit a crime we would have said so”. With congress being dominated by Republicans for the moment, chances of impeachment are slim. However, the issue is in the spotlight since the Democratic overturning of house in the midterm elections, now only awaiting to see what comes from further investigation.
